J A Pye (Oxford) Ltd and Others v Graham and another [2002] UKHL 30 is a House of Lords judgment on adverse possession
Contents |
Pye was the owner of the land and Graham was a squatter. The land had development potential but Pye allowed Graham to use it for grazing under an agreement which was described as a licence. The document expressly stated that the agreement would end on a certain date and that to continue the arrangement a new contract would need to be entered into. Pye did not enter into another agreement because he wanted to develop the land but Graham continued to occupy the land.[1]
The case was litigated as J. A. Pye (Oxford) Ltd and Another v United Kingdom in the European Court on Human Rights.[2]
